Town extends moratorium on sexually oriented businesses

The town of Branford at the urging of Town Attorney, Kevin Daly, extended the moratorium on sexual oriented businesses from November to January 10, 2006.
Daly told the council, “I’ve done research on sexual oriented adult stores in two counties and five cities, Jacksonville, Orlando, Lake Butler, Lake City, and Alachua. Alachua has been working on this issue for months. One of these cities is clearly unconstitutional and I won’t tell you which one. They are all pretty involved with the zoning issue.
The town of Branford is going into it’s third month, and I feel we need two more months to process our plans. He recommended extending the moratorium to January 2006. The town passed a resolution to this effect.
Daly told the council, “The research I’ve done in these places shows that these businesses become magnets for pedofiles and others.”
The resolution establishes a moratorium until January 10, 2006 on the issuance of any permit or application to open, operate or obtain zoning or approval for any sexually oriented business or facility in the town of Branford.
The resolution reads “Whereas the town of Branford has identified a need to curtail where and how sexually oriented businesses or facilities may operate in the Town of Branford; the Town of Branford on May 10, imposed a six month moratorium on the permitting of sexually oriented businesses or facilities; additional time is required to put into place an acceptable ordinance concerning the permitting of sexually oriented businesses or facilities; it is in the interests of the citizens of the Town of Branford to promote the health, safety and general welfare of its citizens by permitting the Town of Branford to review and analyze all issues related to the permitting of approval of, opening, or operation of, any zoning and location of sexually oriented businesses or facilities, and there is a need to continue a moratorium on the issuance of any permit or application to open, operate or obtain zoning or approval for sexually oriented businesses or facilities in the Town of Branford.
The resolution was signed by Town Clerk, Donna Hardin; Joe Pete Cannon, Town Council President; Mayor, Don Owens; and Town Attorney, Kevin Daly.
