Reports state that on Monday, May 11, at 11:15 p.m., a 1993 GMC pickup, driven by Charles Benjamin Wishart, 57, Branford, was traveling north on US 129 in Gilchrist County behind a John Deere tractor, driven by Hugh Dewayne Martin, 71, Bell. The tractor, which was pulling a spray trailer, was making a left turn onto NW 47th Place when the pickup attempted to pass in the left lane. The tractor was halfway through its turn when the right front of the pickup struck the left rear tire of the tractor. Upon impact, both vehicles were redirected in a northern direction and traveled onto the west grass shoulder of US 129. The pickup then struck a sign and a fence before coming to final rest. The tractor and the trailer also came to final rest on the west shoulder facing north.

Wishart received minor injuries in the crash and was not transported. His passenger, Heather Michelle Smith, 27, Branford, sustained serious injuries in the crash and was transported to Shands UF in Gainesville. Martin escaped injury, FHP said.

The report states that Wishart was charged with failure to use due care.
