Fogle sentenced to 15.7 years in prison

ZIONSVILLE, Ind. — Former Subway spokesman Jared Fogle was sentenced today to 15.7 years in prison, after pleading guilty to distributing and receiving child pornography and traveling to engage in commercial sex acts with minors.
After gaining fame for his significant weight-loss attributed to eating Subway sandwiches, Fogle became Subway’s spokesperson from 2000-2015.

Fogle pleaded guilty in August to one count each of traveling to engage in sexual conduct with a minor and to distribution and receipt of child porn after investigators raided his home, seizing electronics in connection to child porn. Though a total of 14 victims were identified in the case, Fogle’s plea agreement is to only the two charges.
U.S. District Court Judge Tanya Walton Pratt said she handed down the tough sentence in part because of the “perverse nature” of Fogle’s crime and to send message of seriousness of the crimes. Pratt said Fogle used wealth and fame to find teen prostitutes and to seek even younger boys and girls to have sex with him.
“I want to redeem my life,” Fogle said Thursday. Fogle also said that “not a day will go by” that he won’t think about the harm he’s done to his victims.
Fogle expressed regret for the damage he did to his wife and two children. Judge Pratt then interrupted, “You gave your wife $7 million. She’ll be OK.”
Fogle defense attorney Andrew DeVooght said Fogle was already suffering “unique” punishment as details of his crime are so well known due to his fame. “No one wants to be Jared Fogle” now.
The defense argued that Fogle deserved leniency because the crimes he committed involved victims in the sex trade, and because he didn’t produce or ask for the child pornography.

Assistant U.S. Attorney Steve DeBrota said Fogle possessed at least 400 child porn videos, “none of them duplicates.”
DeBrota said Fogle was not a passive recipient of child porn videos. DeBrota said Fogle knew the victims and “absolutely knew” they were about to become victims of child porn maker Russell Taylor, the former head of the Jared Foundation. He called Taylor a “monster” but said Fogle was the man who “made the monster.”
He said Fogle knew he was engaging in sex crimes against children but still didn’t stop. “He was having a great time,” DeBrota said.
Fogle also paid restitution totaling $1 million to the 10 of 14 victims. Fogle will be prohibited from possessing porn and must receive sexual disorders treatment. He cannot have unsupervised meetings or communication with minors and cannot be employed or volunteer in a position that places him with minors.
In addition, Fogle must register as a sex offender and consent to searches and computer monitoring. As required by law, he’ll also have to provide a DNA sample.
U.S Attorney Josh Minkler said even after Taylor’s arrest on child pornography charges, Fogle continued to exploit minor females out of state.
“In summary, Fogle has sacrificed absolutely everything he had built — including his family — to engage in sexually explicit conduct with two minors,” Minkler wrote in the notes.
